Services Terms – Qashier Terminal

1. Qashier Terminal Services
These Services Terms supplement the General Terms and govern the Qashier Terminal Services. In the event of a conflict between these Services Terms and the General Terms, these Services Terms will prevail to the extent of the inconsistency with respect to the subject matter of these Services Terms.
2. Qashier Terminal Software; Qashier Terminal Documentation
2.1 Terminal Device Software. Certain Qashier Terminal Products require Terminal Device Software to operate. By using Qashier Terminal Products that include Terminal Device Software, you agree to be bound by the terms of the Terminal Device EULA. You must not use any Qashier Terminal Product in a manner that is inconsistent with the Terminal Device EULA.
2.2 Updates to Terminal Device Software. You must keep the Terminal Device Software up to date by installing Updates as the Terminal Device EULA requires. Qashier may push Updates to your Qashier Terminal Products automatically. You acknowledge that failure to install Updates may result in degraded functionality, security vulnerabilities, or incompatibility with the Qashier Payments Services. Qashier will not be responsible for any issues arising from your failure to install required Updates in a timely manner.
2.3 Qashier Terminal Documentation. All references in these Services Terms and the General Terms to “Documentation” in the context of the Qashier Terminal Services are read as references to Qashier Terminal Documentation. You must use Qashier Terminal Products and Qashier Terminal Services in accordance with the Qashier Terminal Documentation.
3. Use of the Qashier Terminal Services
3.1 General. You may only use the Qashier Terminal Services in compliance with the Terminal Purchase Terms, these Services Terms, and the Agreement. You must not use the Qashier Terminal Services for any purpose that is not expressly permitted by these Services Terms, the General Terms, or the Qashier Terminal Documentation.
3.2 Payment Account Details. You must obtain a Customer’s prior written consent before collecting, using, retaining, or disclosing that Customer’s Payment Account Details in connection with the Qashier Terminal Services. You must provide to Qashier evidence of all required Customer consents promptly upon Qashier’s request. You must ensure that your collection, use, retention, and disclosure of Payment Account Details complies with all applicable Law, PCI Standards, and Payment Method Rules.
3.3 Disclaimer for “Offline” Mode. Certain Qashier Terminal Products may include an “offline” mode that allows you to process Transactions when your internet connection is intermittent, limited, or unavailable. To the maximum extent permitted by Law, the Qashier Parties will not be liable for any losses, damages, costs, or expenses arising from or relating to your use of Qashier Terminal Products or Qashier Terminal Services in offline mode, including any Transactions that are declined, reversed, or not settled due to intermittent, limited, or no internet connectivity. You use offline mode at your own risk.
